This post clarifies the applicability of Rule 5 in the Central Civil Services (Revised Pay) Rules, 2016 (CCS (RP) Rules, 2016) for Department of Posts employees.

Background:

Previous communications from office (dated October 7, 2022 and January 31, 2023) addressed the application of Rule 5 of the CCS (RP) Rules, 2016. This rule allows opting for the revised pay structure under the 7th Central Pay Commission (CPC).

New Clarification from Department of Expenditure:

The Department of Expenditure has issued a clarification (ID Note No. 03-03/2018-E.III.A dated April 16, 2024). This clarification states that:

  • Employees cannot opt for the revised pay structure after the notification date of the CCS (RP) Rules, 2016 (July 25, 2016) based on promotions or financial upgrades happening after that date.
  • Rule 5 of the CCS (RP) Rules, 2016 only allows opting for the revised pay structure for promotions or upgrades that occurred up to July 25, 2016.

Impact on Departmental Decisions:

Based on this new clarification, all similar cases within Circle should be reviewed and decided in accordance with the Department of Expenditure’s explanation.

Previous Benefits:

Any benefits granted based on previous communications (dated October 7, 2022 and January 31, 2023) on this subject may be withdrawn.

Important Note:

This update supersedes previous communications  regarding the applicability of Rule 5 in the CCS (RP) Rules, 2016.
